There are several cases like that. The issue in such cases is actual causation. Cases like these make it clear that "but for" causation is insufficient. In this case, neither of the fires was a "but for" cause of the damage, so neither party would be liable if that test were applied. Out of cases like this comes the "substantial factor" test, whereby both parties are an actual cause of the damage if either would have caused the damage by himself.Claude Said:
