From a lawyer. I have attached a copy of the criminal complaint against New York Governor Spitzer and others involved in the prostitute ring. It's the real thing.

Tamara Said:

what is criminal case and civil case?

We Answered:

A civil case is when someone sues someone for violating their civil rights. These cases are determined by a judge instead of a jury. You can be sued in a civil case, but you cannot be put in prison.
A criminal case is when charges are pressed against someone for committing a crime. This cases are determined by a jury. You can be sued, put in prison or both in these cases.

OJ Simpson won his criminal case. He was found innocent of murder. But the family sued him in civil court for violating the victim's right to live. The right to live is one of your civil rights. He lost that case, and was sued. But because you cannot be put in jail from a civil case, he got out of it.

Help with a Criminal case study?

We Answered:

One element to consider would be whether or not there was a felony murder law.

"Felony Murder Doctrine
n. If a death occurs during a felony, it is considered to be first degree murder and all of the felony's participants (or attempted felony's participants) can be charged and found guilty of murder. For example: if a robbery involves more than one criminal and one of them kills a clerk, all of the participants can be found guilty of murder even if they all did not have a gun or intend to hurt anyone. Similarly, if one of the holdup men or women is killed, his/her fellow robbers can be charged with murder."

Case Study For Criminal Justice?

We Answered:

Reasonable suspicion exists that a crime is, was, or is about to be committed due to the circumstances you have shown, and supported by other cases. An observation (stakeout) of the premises would be taken place - vehicles being brought in may be stopped due to the reasonable suspicion. There are also many other avenues - the Department of Consumer Affairs may have an inspection of the premises if they are under the guise as a repair shop, the DMV may also have full access to go over their Bills of Ladings for all work performed. There are many consumer protection groups that may go in, and thus helping to establish Probable Cause for a Search Warrant. Having an undercover go in and establish probable cause with the two-prong rule will also establish reasoning for the issuance of a search warrant.
