The LEA are looking to save money, if they don't statement him they don't need to pay for his specific needs to be addressed.

Threaten them with the DDA, disability equality duty and anythin else you can think of.

This happens all too often and while the LEA is saving money children like your son get left behind and other kids in the class may also suffer (depending on your so's needs),

IS your son disruptive at all? If so get the parents of other kids to complain to the LEA about the effect on their children. And get them to threaten to sue.Once the LEA sees a large bill looming they will miraculously give your son a statement.

Stick at them it will be worth it in the end.
