Forget the suit. You have no demonstrable loss. Further, you do not have "clean hands," because you already have a conviction for a controlled substance. Moreover, the suit might generate more publicity than the error. Get the record changed, and get on with your life. Besides, as a former prosecutor, I know that it's an odds-on bet that the criminal complaint/indictment is not for pot. It's for coca-alkaloids or opiates, no matter that a few thousand legal dollars bought you a misdemeanor. IMHO, you should not be in any field awash in pharmaceuticals, for your own health and the health of others.
